#50: Twice-convicted gun offender shot a random driver while on felony bail, prosecutors say

Chicago — Prosecutors say a man who was on bail for selling nearly $3,500 worth of cocaine to an undercover cop shot a motorist who was driving to work near his home on November 3.

Giovanni Montes, 24, is the 50th person accused of killing or shooting—or attempting to kill or shoot—someone in Chicago while awaiting trial for a felony this year. The alleged crimes involved at least 88 victims, 22 of whom died.

Officials said that Montes, who has been convicted of illegal gun possession twice since 2017, was seen on video walking near the 2400 block of West 26th Street around 6:42 p.m. on the night of the shooting. The footage also allegedly showed him shooting at a truck that passed by and walking home after firing shots.

Bullets struck the truck’s back window, the driver’s headrest, and a door, an assistant state’s attorney said during Montes’ bail hearing on Thanksgiving afternoon.

One bullet hit the driver in his shoulder.

Investigators circulated surveillance images of the gunman to Chicago police officers, and a cop in the Ogden (10th) District recognized Montes because they had arrested him several times in the past. Based on that information, detectives included Montes in a photo lineup, and the victim identified him as the shooter, according to prosecutors.

The victim claimed that he had never seen Montes before the shooting.

Prosecutors charged Montes with aggravated battery by discharging a firearm.

Judge Barbara Dawkins ordered him to pay a $50,000 bail deposit to go home on electronic monitoring. Dawkins also held him without bail for violating the bond in his pending manufacture-delivery case until the judge handling that matter reviews the new charges.
