Judge detains man accused of firing shots that prompted Logan Square SWAT response

Oswaldo Pena (Chicago Police Department)

CHICAGO — Charges have been filed in connection with Wednesday night’s SWAT incident in Logan Square.

Witnesses called 911 around 10 p.m., reporting that a man had fired shots from a back yard and a second-floor window in the 3000 block of West Wellington. According to CPD, responding officers saw a man with a gun enter a home, and they summoned the SWAT team.

Cops found shell casings on a sidewalk and in the back yard of a home on the corner of Wellington and Whipple, according to a CPD report. The police removed eight people from the house and arrested Oswaldo Pena, 35, after a witness identified him as the shooter, the report said.

Officers allegedly found a pistol grip in his pants pocket. SWAT officers who cleared the building found a loaded firearm magazine in one of the bedrooms, according to the report.

Police listed the home police evacuated as Pena’s residence. He is charged with reckless discharge of a firearm and reckless conduct. Judge Caroline Glennon-Goodman detained him at the state’s request.

Court records show Pena was charged with misdemeanor domestic battery last month, and a judge ordered him not to possess firearms while that case was pending. However, the judge’s order ended on August 19, when the alleged victim failed to appear in court and prosecutors dropped the case.
