Felon gets 12 years for mugging 92-year-old man, possessing a firearm

D’Marco Roby (Chicago Police Department)

CHICAGO — A man who escaped from electronic monitoring to mug a 92-year-old man at a South Side ATM has been given a 12-year prison sentence.

D’Marco Roby, 27, was on parole for the gun cases in September 2022; Chicago police officers said he dropped a firearm while running from them in Englewood. He remained in custody on a Class X felony gun charge until February 2024. That’s when Judge Laura Ayala-Gonzalez, reviewing his pretrial conditions under the SAFE-T Act, sent him home on an ankle monitor, court records show.

Within months, he went missing after failing to return to the home where he was supposed to be living on house arrest.

It didn’t take long for him to pop up again. In less than four weeks, Roby and an unknown accomplice saw an opportunity when they crossed paths with a 92-year-old man withdrawing money from an ATM at Citgo, 251 West 63rd Street. As the nonagenarian completed his transaction, Roby and his partner moved in.

Prosecutors said Roby punched the elderly man in the face and body, knocking him to the ground and “forcibly” taking his wallet.

Chicago cops arrest Roby within hours to face charges of robbery and escape from electronic monitoring.

Now, Roby has resolved all three pending felony cases: he pleaded guilty to a lesser charge of being a felon in possession of a firearm in the gun case and guilty to robbery of a victim older than 60 for mugging the 92-year-old. Prosecutors dropped the escape charge he faced.

Judge Ayala-Gonzalez gave him eight years for the gun charge and Judge Ursula Walowski sentenced him to four years for the robbery case, according to court records. Those sentences, served consecutively, will be reduced by 50% for good behavior. He’s expected to be paroled in October 2028.

Records show Roby has two previous convictions for being a felon in possession of a firearm, both in 2018.
