A man on parole for a 2005 murder is heading back to prison after prosecutors accused him of opening fire on another man in Austin just a half mile from where he killed someone 20 years ago.
Damien Atterberry, 39, is charged with aggravated discharge of a firearm for the August 23 shooting in the 1200 block of North Lavergne Avenue. Prosecutors said a Chicago Police Department surveillance camera recorded Atterberry firing at least six rounds toward a 49-year-old man around 5 p.m.
Automatic license plate readers tracked Atterberry’s red Hyundai Sonata fleeing the area, officials said. The following afternoon, police again picked up the car’s movements and found it parked in the 1200 block of South Harding.

Officers saw Atterberry get out of the driver’s seat and detained him, according to a CPD report. They said they found a 9mm shell casing in the rear passenger door panel. The vehicle also bore a bullet hole on its rear passenger side and two patched-over holes on the front passenger side.
Judge Ankur Srivastava ordered Atterberry detained. Illinois Department of Corrections records confirm that his parole has been revoked and he is back in state custody. His new release date is set for May 14, 2027.
Atterberry was convicted of second-degree murder and aggravated battery with a firearm for a 2005 killing in the 1100 block of North Leamington Avenue. He was sentenced to 20 years in prison and released on parole in April of last year.
